Ms. Main (her website is here) is an attorney who practiced law in New York City for ten years. She litigated a wide variety of commercial cases involving real-estate-related disputes, the First Amendment, fraud, art law, and civil rights. During her early years as a lawyer, Ms. Main represented condemning authorities in New York City and conducted public hearings at which individuals whose property was being condemned often came forward to protest the project.Until 2005 Ms. Main was an Associate Editor of The National Law Journal, where she edited the opinion page of the paper and wrote a column on law and society. Her writing has appeared in The Wall Street Journal, Policy Review, National Review, The American Lawyer, and The New York Sun, among many other publications. Wright Gore III’s family owns Western Seafood in Freeport, Texas. The city government in Freeport has been using eminent domain to take Western Seafood to give to a developer to build a marina. I interviewed Wright two years ago on my blog and as a guest host on another Right Talk show. We will talk about the morality and legality of such eminent domain cases and the American Judiciary’s complicity in allowing governments to take land from some to give to others.
SueBob, there are some disparities in training, and some of my fellow cops are not very good at taking criticism either. Neither of these cases is very pretty. The Texas case seems especially egregious, altho I don't have enough info on the Las Vegas incident.
However, I like the Taser for what it can do and for what it does not do. First of all, let me clarify that I volunteered for and took a shot - complete with barbs - from a Taser as part of a training exercise at age 51 (and have the T-shirt to prove it). It was among the most unpleasant experiences of my life. However, the full burst that I took lasted only 5 seconds (altho it seemed like 50) and no one assisting me to keep me from hitting the floor in the training was injured.
While there may have been some serious issues in these two cases, the Taser itself did not injure these guys. Beating on them, however, did. The electrical flow cauterizes the wound, and the barb only penetrates 1/4 inch. I did not even feel the barb when it was removed from my back, and the trainer fired at me from 5 feet. The wound was healed in 5 days, and I had no residual effects.
Laughing, mimicking, Tasering for the fun of it are all really unprofessional. Tasering for fun (for no legal reason) is assault. It is certainly actionable. Over reacting is a serious training issue as well, and it seems certain that the communication in the invalid's case was sub-standard - another training issue. (How in the world does a call for medics turn into an assault on a house and a physical force action by police while the caller is trying to tell the officers that it is a medical emergency?)
But don't throw away the Tasers! They are a great tool, and if Compean had been able to use one on our drug-running illegal alien Aldrete-Davila, Davila would would more likely be in prison while our BP friends would have already forgotten the incident. Unless of course, US Attorney Johnny Sutton thought that was a civil rights violation.

Hi, my name is Gene Pinkham and I write for the Malden Observer in Malden, MA. I had the opportunity Saturday night to interview a Border Patrol Agent who is an old friend of my best friend's wife. We talked about the border situation in general but then I brought up the two guys that got jailed for shooting a drug dealer.
OH BOY! He told me that the guy that got shot in the ass was known to be a member of the Ciarilao Fuentes Cartel which is aligned with the Mexicali Cartel. He was involved in the "House of Slaughter" in Juarez Mexico where 30 people were killed. He had documents provided to him by the DEA because he is an informant. He has two people covering for him. US Attorney Johnny Sutton and his prosecutor Debra Kanof who has a history of prosecuting Law Enforcement.

[...] Two years ago, I went to Crawford to support the troops against Sheehan’s gang. The occupation of Iraq has gone on and on. I reached a point, after viewing the nuttiness of the Arab street over the Mohammed cartoons and concluded that we are crazy for spending our young people’s lives and our money (borrowed from the Chinese) to help them “nation-build”.
Eric: You have almost set a record for logical fallacies in one short sentence.(Bifurcation, Hasty Generalization, and False Analogy)

Less than 300 Texians were killed at the Alamo. Historically, did that make it only a minor skirmish? Or maybe the Texians were bad shots? Were they heroes or just too dumb to leave when they had the chance? Too many other factors are missing.

When you called the Public Affairs Officer, did you ask if there was an increase in armed encounters of late on the border? The numbers may have had a bearing on your argument.

I fear that Sutton's prosecution team had a similar pre-conceived notion i.e., Since few BP agents are killed in the line of duty, all illegal crossers must be truthful and non-violent. So why not take the word of a poor drug smuggler who only wanted to make a little money to help his sick mother over the word of Ramos and Compean.
The Border is dangerous - period. My Father, my son, my daughter-in-law and I know that, all of us having served as Border Patrol Agents. Nobody needs to get killed to prove it.
